Terms of service

1. The agreement

These terms are between you and Triangle Interactive, LLC (“we”, “us”), the operator of Gensprite — the service at gensprite.ai and api.gensprite.ai that generates game sprites, turnarounds and animations, reached through the web workshop and HTTP API. Using either means accepting these terms.

2. Your account

You must be at least 13 years old. Accounts are passwordless — you sign in with an email link or through Google or GitHub — which means your email inbox is effectively your credential, and keeping it secure is your responsibility. So are your API keys: each secret is shown once, we store only a hash, and everything done with a key counts as done by you. Revoke lost keys in Settings immediately.

3. Credits

Generations cost credits. The price of every kind of generation is quoted before you commit — on the bench, or via the API’s quote endpoint — and is never buried in a document like this one. How credits behave:

  • New accounts receive a one-time grant of 50 credits, valid for 365 days.
  • Credit packs are one-off purchases, valid for 365 days from purchase.
  • Plans grant credits each billing period. Unspent plan credits carry into the next period up to one period’s allowance; the rest expires. When a plan lapses, its remaining credits expire at the end of the period already paid for.
  • Credits are always spent from the soonest-expiring batch first.
  • Balances migrated from the previous version of Gensprite never expire. That promise predates these terms and survives them.
  • A generation that fails or is cancelled refunds its credits automatically and in full. Credits have no cash value and, apart from what the refund policy says, are not convertible back into money.

4. Purchases

Payments are processed by Stripe. An account holds at most one running plan; plan changes, proration, tax and failed-payment handling are managed through Stripe’s billing portal, reached from the Billing page. Cancelling a plan stops future charges — the period already paid for runs to its end, and nothing already granted is taken back. Refunds of money are covered by the refund policy.

5. Your content

What you make is yours. You retain ownership of the prompts and images you provide and of the sprites, turnarounds and animations generated for you, and you may use them for any purpose, commercial ones included, with no attribution owed. You grant us only the license needed to operate the service: to process your inputs through our generation providers and to store the results for you. We do not train models on your content, and we do not showcase your work publicly without asking you first.

You are responsible for what you put in — inputs must not infringe anyone else’s rights — and for confirming that your use of generated output is lawful in your jurisdiction. The service itself, its code and design, remains ours.

6. Acceptable use

  • No content that is illegal or infringes others’ rights.
  • Generations refused by the safety checker fail and refund automatically; repeatedly attempting to circumvent it is a violation of these terms.
  • No interfering with the service: probing, overloading, reselling access, or sharing API keys to evade limits.

We may suspend or terminate accounts that violate these terms. Credits in an account terminated for violations are forfeited.

7. The service, as it is

Gensprite is provided as is. Generative models are probabilistic: a completed job means the pipeline ran, not that the art meets your hopes, and quality of output is not warranted. We do not promise uninterrupted availability. Generated files are retained as described in the privacy policy — kept while your account has credits or a plan, and for 90 announced days after it empties.

8. Liability

To the maximum extent the law allows, we are not liable for indirect, incidental or consequential damages, and our total liability for any claim is capped at the amount you paid us in the twelve months before the claim arose.

9. Changes and governing law

We may update these terms; the date above changes when we do, and material changes are announced by email. These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles.
